Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling more than 4-feet to the ground below while working from rolling stock: This violation most recently occurred on or about March 10, 2011, and at times prior to, at the workplace located at 9314 West Jefferson Boulevard, Dallas, Texas 75052 where at least one (1) employee securing a rolled up tarp to the bed of a flatbed trailer, aka the G5 Skin- trailer, was exposed to the hazard of falling more than 4-feet to the ground below. Among other methods, one feasible and acceptable means of abatement includes, but is not limited to: perform an assessment of the employee's job and ensure that they have received adequate training and equipment to perform the job safely. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees working from rolling stock have received the training and equipment to perform the job safely.
