Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling and/or crushing hazards due to a faulty dock leveler. Warehouse: The employer not only made a modification without a written approval from the manufacturer, but also did not ensure through servicing and conducting regular maintenance per manufacturer's specification and recommendations that the Kelley Co. Dock Leveler (Model # 2250 and Serial # 391) installed at the truck loading area was working safely and functioning properly at all times. On or about March 25, 2010, the above dock leveler was not functioning properly and descended, causing an employee along a metal dumpster to fall onto the ground. The metal dumpster landed onto the employee's legs and caused severe injuries to both legs. Among other methods, one feasible and acceptable abatement method to correct the hazard is to: 1. Follow ANSI Standard MH30.1-2000 section 4.4.4 which states that periodic maintenance and inspection procedures shall be followed according to the manufacturer. 2. Follow ANSI Standard MH30.1-2000 section 4.4.7 which states that any modifications or alterations of dock leveling devices shall be made only with the written permission of the manufacturer. 3. Follow the manufacturer's manual and instructions. 4. Utilize other safe and effective engineering technologies.
