Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to deficiencies to the hoists by not conducting frequent and periodic inspections: (a)Facility, 136 Lincoln Avenue, East Butler, PA: On or about 10/05/10 the employer did not conduct inspections of the upper limit devices of hoists at the beginning of each shift. The hoists in the facility are used daily by employees to move materials. (b)Facility, 136 Lincoln Avenue, East Butler, PA: On or about 10/05/10 the employer did not conduct periodic inspections, with records, of the hoists used in the facility. Among other methods, one feasible and acceptable abatement method to correct these hazards is to follow the manufacturer's recommendations for daily inspections of the upper limit device and to conduct periodic inspections and maintain records to provide a basis for a continuing evaluation.
