Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from the rotating structure and hoisting arm of the excavator: (a) EMF Development Corp. On or about 11/23/10 the "Kobelco" Mark-SK-220 excavator was being operated with the hydraulic cylinders of the hoisting arm leaking fluids at a rate of 1 gallon per week. In addition, the rotating audible alarm lights and brake lights were completely broken from the equipment. One feasible and acceptable method of abatement would be to follow the manufacturer's preventative maintenance recommendations and guidelines for repair of the leaking hydraulic cylinders; broken rotating lights and broken brake lights/alarm; the Power Crane and Shovel Association Standards No. 1, 2, and 3; and 29 CFR 1926.602.
