Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the mill, on or about February, 2010 and prior thereto, a Toyota powered industrial truck was used to lift employees on a wooden pallet that was not attached to the powered industrial truck and employees were not provided with fall protection. This condition exposed employees to the hazard of falls from elevation and being struck by the platform. Among other methods, a feasible and acceptable method to correct this hazard would be to fabricate a work platform with a guardrails system and follow the work procedures that are listed in ANSI B56.6.(Section 5.12).
