P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of being struck by flying tire debris: a)At the loading dock, on or about January 19, 2012 and at times prior to, employees who chocked the tires on trailer #489004 were exposed to being struck by flying tire debris due to the potential failure and rapid pressure loss of excessively worn trailer tires, which had visible ply/belt cords. ABATEMENT CERTIFICATION IS NOT REQUIRED. One feasible and acceptable means of abatement is to implement an inspection and maintenance procedure to ensure that excessively worn tires with visible ply/belt cords are replaced on yard trailers prior to use.r
