P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) At the 2nd floor of the College of Coastal of Georgia on or about July 27, 2011, for the employer allowing an employee to use a defective self-supporting, eight-foot, fiberglass Louisville Model FS 1508 step-ladder, that had obvious defects such as but not limited to, fiberglass side rail corrosion, broken and/or bent locking spreader bars, cracks in the ladder side rails, bent ladder rungs, and the ladder feet were missing anti-skid pads, used by an employee to troubleshoot an overhead door, was taken out of service and destroyed. Among other methods, one feasible and acceptable method to correct the hazard is: A thorough ladder inspection shall be made when the ladder is originally purchased, received, and put into service. The ladder shall be inspected periodically, preferably before each use. Working parts and rung/step-to-side rail connections shall be checked. Where structural damage or other hazardous defect(s) are found, the ladder shall be taken out of service and either discarded or repaired by a competent mechanic. Reference: ANSI-ASC A14.5-2007, Chapter 9, Selection, Care, and Use, Section 9-4, Paragraphs 9.4.1 and 9.4.2 ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.
