P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being burned by a fire from vehicles and other mobile equipment colliding with an above ground tank containing diesel fuel: A) Recycling area, on or about June 30, 2010, an above ground tank with a dispensing unit on top, containing diesel fuel, did not have barriers installed to prevent mobile equipment or vehicles from colliding with the tank, exposing employees to a fire hazard. One feasible and acceptable abatement method to correct this hazard is to install barricades around the diesel tank to prevent vehicles and other equipment from colliding with the tank. ABATEMENT CERTIFICATION IS REQUIRED.
