Text For Citation: 01 Item/Group: 001 Hazard: UNAPEQUIP

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being inadvertently caught in the point of operation of the press brake(s) due to the unintended actuation of the foot control, and/or foot treadle: On or before 01/15/2010, the foot control and/or the foot treadle used to initiate the stroke of the press brake(s) were not guarded to prevent unintended actuation, thus exposing employees to crushing injuries and amputation hazards. Equipment includes; but is not limited to, the 250 ton Cincinnati mechanical press brake and the 70 ton Pacific hydraulic press brake. NOTE: A feasible and acceptable means of abatement includes but is not limited to the following: Compliance with the American National Standards Institute (ANSI) B11.3 2002, [Section 6.11.3.1] which states that" when provided foot controls and /or foot treadles of the type that serves as an operator control shall be equipped with a means to prevent unintended machine actuation.
