Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injury or death if forklift turned over while seatbelt was not being used: (a)Micronesian Brokers, outside warehouse three: A warehouse driver was exposed to injury or death if his forklift overturned while he operated the equipment without wearing the seatbelt installed on the equipment. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD: The employer must require employees to wear seatbelts and strickly enforce this requirement.an
