Text For Citation: 01 Item/Group: 001 Hazard: FALLING

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: a)Jobsite, 515 Route 70, Brick, NJ, In front of Retail Space E: An employee was working from the platform of the JCB Loadall Lift, serial # USA50636RE0572285, observed on or about 2/24/10. Among other means, one feasible and acceptable abatement method to correct this hazard is to utilize safety platforms that meet the requirements of the American Society of Safety Engineers, ASME/ANSI B56.6-1987, Safety Standard for Rough Terrain Forklift Trucks, Section 5.15 Elevating Personnel. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.CE
