Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to oxygen deficient atmospheres from the improper design of process equipment and the lack of proper monitoring equipment of the atmosphere: a. On or about March 12, 2010, near the freezer in the RTE 2 room, employees suffered adverse health effects including, but not limited to, lightheadedness, dizziness, headaches and extreme tiredness resulting from an oxygen deficient atmosphere. The effects resulted from inadequate ventilation of nitrogen, an asphyxiant, and a lack of appropriate monitoring equipment of the atmosphere inside the room. Abatement note: Among other methods, one feasible and acceptable means of abatement would be to comply with the guidelines outlined in the Compressed Gas Association, Inc., Safety Bulletin 2, "Oxygen Deficient Atmospheres" 2007 Edition and the Compressed Gas Association, Inc., P-1 "Safe Handling of Compressed Gases in Containers" 2008 Edition. NOTE: 29 CFR REQUIRES THAT YOU PROVIDE CERTIFICATION AND DOCUMENTATION OF ABATEMENT FOR THIS ITEM.
