Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a.) On or about November 30, 2009, at a jobsite located at 400 East 130th Street, Chicago, Illinois - an employee operating a New Holland LS180 Skid Steer exited the cab while the vehicle was still running and the bucket elevated, thereby exposing the employee to being crushed and/or caught between the skid steer loader and its parts while in operation. Among other methods, one feasible and acceptable means to correct these hazards would be to follow the New Holland LS180 Skid Steer Loader Operator's Manual, and/or The Equipment Manufacturers Institute (EMI) Skid Steer Loader Safety Manual which states "CAUTION: Never enter or exit the skid steer unless the boom and attachment are resting on the ground or on the boom lock pins." b.) On or about November 30, 2009, at a jobsite located at 400 East 130th Street, Chicago, Illinois - an employee was operating a New Holland LS180 Skid Steer Loader which had a steel pole welded to the bucket, thereby exposing the employee to struck by hazards. One feasible and accept abatement method, among others, to correct the hazard would be to comply with the Equipment Manufacturers Institute (EMI) Skid Steer Loader Safety Manual which states "Never modify or remove any part of the machine."
