Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free of recognized hazards that are causing or are likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of parts of their body being crushed or amputated due to contact with the moving parts of the forklift: a) In building number 810 at the area of the push back storage racks. A fork mounted work platform, manufactured by Vestil Manufacturing Corporation, is used to elevate forklift operators to various levels of the push back storage racks to remove stuck pallets. Employees were not protected from contact with the moving parts of the forklift because the yellow top guard section of the expanded metal back side of the platform had been removed. This condition was observed on 2/9/2010 with the Safety Manager present. A feasible and acceptable method to correct this hazard is to reinstall the yellow expanded metal guard, and insure that the guard remains in place, so that employees are protected from the moving parts of the forklift as indicated by the owners manual for the Vestil Work Platform, and by standard ANSI/ASME B56.1, "Safety Standard For Low Lift and High Lift Fork Trucks" or ITSDF B56.1-2005, "Safety Standard for Low Lift and High Lift Trucks.
