NYSLL Article 2, Section 27-1(3)(a)(1): The employer did not furnish to each of its employees. employment and a place of employment which was free from recognized hazards that are causing or were likely to cause death or serious physical harm to its employees and which will provide reasonable and adequate protection to the lives, safety or health of its employees. In applying this paragraph fundamental distinctions between private and public employment have been recognized. NOTE: The employees were exposed to the hazards of serious injury or death from falls when using modified stairs. Feasible means of of abatement could include installing a stairway designed for access through a hatchway, as per OGS specifications. a) NYSDOCCS Great Meadow Corr.Fac.- The upper Alternating Tread Stairway in the temporary tower was modified by cutting off the handrails at the top and attaching the stairway to a hatchway. The handrails are specified by OGS project number M2848-C, drawing number 5-PH103.
