Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: (a) Location - Harbor Street, Salem, MA: On or about 10/13/09, the employer failed to adequately train employees to operate and work around a Labrie Top Select recycling truck. Among other methods, one feasible and acceptable means to correct this hazard is to develop a clear, concise work rule pertaining to all safety aspects of working with and around the recycling truck including hydraulic bucket safety. Train and retrain all personnel accordingly.
