North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the struck-by hazard due to errors in hoist operation resulting from inadequate markings on the electric powered hoist: a)facility, yard, boat hoist - the rated load of the electric powered hoist was not marked on the hoist so as to be legible from the ground. b)facility, yard, boat hoist - the electric powered hoist was not marked with the name of the manufacturer, model or serial number, and the voltage. c)facility, yard, boat hoist - the electric powered hoist was not provided with a label displaying information concerning operating procedures to include lifting over people. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to mark the hoist in accordance with ASME B30.16-2007, sections 16-1.1.1 Rated Load, 16-1.1.3 Identification, and 16-1.1.4 Warnings. Reference:American Society of Mechanical Engineers (ASME) B30.16-2007, Safety Standards for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings.
