Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees operating chain hoists were exposed to struck-by hazards, due to the chain hoists not being marked with their load ratings. a.Republic Engineered Products, Inc. located in Lorain, Ohio: On or about June 24, 2010, the employer did not ensure the chain hoist used to place a 200 pound hub onto the spindle for Cold Saw #1, located in the Conditioning Building, was marked as to its load rating. b.Republic Engineered Products, Inc. located in Lorain, Ohio: On or about June 24, 2010, the employer did not ensure the chain hoist used to place a 200 pound hub onto the spindle for Cold Saw #2, located in the Conditioning Building, was marked as to its load rating. Among other methods, a feasible abatement method to correct this hazard is to comply with the requirements of ASME B30.16-2007 "Overhead Hoists" Overhead, Section 16-1.1: Marking. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation ( using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
