Text For Citation: 01 Item/Group: 001 Hazard: DUST&FUMES
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fire and explosion as effective means were not used to prevent the escape of dust from process equipment into the surrounding environment: (a) D & D Ingredient Distributors Inc., 5025 North Kill Road, Delphos, Ohio: On or about October 19, 2009, the employer did not ensure that methods to control the release of combustible dust were implemented. Ingredients were classified as explosive and Class II dusts and were dropped approximately 20 feet from the ceiling into the combined process and flat storage area creating a significant dust cloud. Among other methods, feasible abatement methods to correct this hazard are to install appropriate dust controls compliant with National Fire Protection Agency (NFPA) 61, Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities, 2008 edition, Chapter 10, Dust Control, 10.3 Dust Emissions, 10.3.1., A method shall be used to prevent the escape of dust from process equipment into the surrounding environment. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation ( using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
