Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: employees were exposed to a struck-by hazard. (a)At the jobsite located at Port Kent, NY, on or about 7/18/11: A Barbco 36-500 auger-boring machine was not being operated in accordance with the manufacturer's instructions that state "always securely attach the casing to the master casing pusher." The casing was not secured to the casing pusher which increased the likelihood of the machine overturning. Abatement Note: Among other methods, one feasible means of abatement for this hazard is: 1)Follow the manufacturer's instruction for "Operation Safety" under the heading "DANGER-MACHINE UPSET" which states: "Always securely attach the casing to the master casing pusher. The weight of the casing and the ground resistance add to the stability of the machine, deterring machine upset." 2)Ensure that additional precautions are taken to prevent machine upset during use, i.e. anchoring track sections to a suitable base.
