Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employees were exposed to fire and explosion hazards resulting from construction work operations performed in a Class 1 Divison 2 area. (a)Inside digester building, during construction work, on or prior to 3/11/10: A Hot Work Permit system was not utilized to ensure fire and explosion hazards, including those created by welding operations and temporary electric wiring, were controlled prior to beginning work. Abatement note: Among other methods, one feasible method of abatement for this hazard is utilization of a Hot Work Permit system, which meets the requirements of NFPA 51B, Standard for Fire Prevention During Welding, Cutting, and Other Hot Work, 2009 Edition. Pursuant to 29 CFR 1903.19(d), the employer must provide certification to OSHA that this violation has been abated within 10 calendar days of the "Date by which Violation Must be Abated".
