Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Truck Terminal, 367 American Oil Rd. Rensselaer, NY- on or about 11/12/2009- The storage of rags and papers contaminated with combustible and flammables liquids in open metal cans exposed employees to fire and explosion hazards. Among other methods, acceptable abatement would be the use of metal cans equipped with a closed lid. NOTE to employer NFPA 30 Flammable and Combustible Liquids Code 2008 Edition: 21.6.6.5 Combustible waste material and residues in operating areas shall be kept to a minimum, stored in covered metal containers, and disposed of daily.
