Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a. At the establishment of PR Police, Highway Division, located at Road 52 Km 58.0 in Salinas. Employees were expose to receive serious injuries and illness such as: heat stress. In the work area employees were exposed to temperatures ranging from 86.9 to 89.5 degrees of temperature where the combination of humidity between 72 and 76 the employees felt a heat factor of between 98.0to 108The A/C was not working, about 1 month ago.According to the employer, they conducted efforts with Highway Authority owner of the building and have not solved the situations. Among other feasible and acceptable methods can be used to reduce heat stress hazards in workplaces. These include, but are not limited to: a.Repair and maintenance of central air conditioning system; Note: Section 6(h) of the Puerto Rico Occupational and Health Act: Each owner of any premises used in whole or in part as a place of employment, did not comply with all the occupational safety and health standards and all rules, regulations and orders issued pursuant to this act with respect to those parts of the premises under his control and not under the control of the employer a. En el establecimiento de la Policia de PR, Division de Autopistas, localizado en Carr #2 KM 58.0 en Salinas. Empleados fueron expuestos a recibir lesiones y enfermedades serias tales como, estres termico, debido a: La exposicion a temperaturas que oscilan entre 86.9 a 89.5 grados de temperatura, donde la combinacion de humedad entre 72 y 76, los empleados sentian un factor de calor entre el 98.0a 108El A/C no estaba funcionando desde hace alrededor de 1 mes. De acuerdo a las gestiones realizadas por el patrono, la Autoridad de Carreteras, propietarios del local no han resuelto nada. Entre otros metodos viables y aceptables que se puede utilizar para reducir el estres termico en los lugares de trabajo. Estos incluyen, pero no estan limitados a: a. Reparar y brindarle mantenimiento al sistema central de aire acondicionado; Nota: Seccion 6(h) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: Cada lugar de cualquier local usado todo o en parte como un sitio de empleo, no cumplio con las normas de seguridad y salud ocupacional y todas las reglas, reglamentos y ordenesde acuerdo con esta ley, respecto a aquellas partes del local bajo su control y no bajo el control del patrono.
