Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicular traffic while shoveling and compressing soil in roadway: JOBSITE: The employees, exposed to vehicular traffic while shoveling and compressing soil in a roadway, were not wearing high visibility safety apparel or other effective and safe means were utilized. Among other methods, one feasible and acceptable method to correct the hazard is to: 1. Ensure that employees wear high visibility safety apparel at all times while working in the road. 2. Utilize other safe means.
