Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to injuries: a) On or about September 15, 2010, and at times prior, employees were exposed to injuries because the employer allowed them to use a hand elevator (hoistway) near the main storage bins which was not regularly inspected by a qualified elevator inspector. ASME A17.1-2007 requires periodic inspections (recommended every 6 months) of hand elevators per section 8.11.2.1. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that an inspector meeting the qualifications of ASME QEI-1 and certified by an organization accredited by ASME makes periodic inspections of the hand elevator.
