Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to hazards from utilizing un-serviceable body belts: a. On or about September 17, 2009, and at times prior, some body belts, used with order picker powered industrial trucks, were not serviceable. The un-serviceable body belts were cracked and the belt material was frayed. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to follow the manufacturers recommendations for inspecting and replacing body belts. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
