Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burn and/or explosion hazards: (a) Amphitheater, on or about August 27, 2009, for an employee who was injured due to the premature ignition of pyrotechnic shells. One feasible and acceptable means of abatement would be to follow the requirements of NFPA 1123, 9.3.4 and ensure that when fireworks are being loaded into mortars or otherwise set up for firing at the display site, cables from the electrical firing unit are disconnected.
