Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: employees were exposed of being thrown out of the vehicle for not wearing seat belts. a) On or about 08-17-09 at the work site, employees were operating the front-end loaders without seat belts. Seat belt were not worn during operation to prevent serious injury or death in the event of an accident or a machine overturn. Employees were exposed to fractures or death. Among one feasible and acceptable abatement method to correct this hazard would be to: 1. Require use of seat belts.
