Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to a crushed-by hazard. The employer does not provide appropriate equipment to raise and block heavy industrial equipment, such as, but not limited to, powered industrial trucks when employees perform tire servicing, maintenance, and replacement. This violation last occurred on September 18, 2009, at the job site located at H&S Construction, 1616 Corn Products Rd., Corpus Christi, TX 78409. Employees use inappropriate equipment, such as, but not limited to, the following, to raise heavy industrial equipment: a.Adapters and accessories which are not provided initially by the jack manufacturer of an Air/Manual Bottle Jack 18202. b.Deteriorated, cracked wooden blocks. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps it is taking to ensure that employees are provided with appropriate equipment for raising and blocking heavy industrial equipment. Among other feasible methods to correct the identified hazard, one method would be to comply with the recommendations published by the manufacturer of an Omega Lift Equipment Air/Manual hydraulic bottle jacks as found in the Operating Instructions & Parts Manual and to comply with ASME B30.1-2009, Safety Standard for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings. In the Alternative: 29 CFR 1910.244(a)(2)(iii): When the load was raised, it was not cribbed, blocked, or otherwise secured at once.
