Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were allowed to operate mobile equipment without wearing seat- belts. (a)Loading Dock area, East of plant's Northeast corner, and throughout the LPG- Tank Storage Yard - On or about Saturday, October 9, 2010, employee(s) were allowed to operate rough-terrain forklifts (telehandlers), i.e. Lull Model 6K-37, Company #2, transporting heavy loads, while not wearing the provided seat belts. Among other methods, one feasible and acceptable abatement method to correct this hazard is to implement a well-communicated, and well-enforced requirement that all operators of rough terrain forklift trucks, equipped with operator restraint systems, must wear the seat belts, as required by Paragraph 6.2.1(a) of American Society of Mechanical Engineers (ASME) B56.6- 2005 (with addenda) Safety Standard for Rough Terrain Forklift Trucks.
