Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that there were no operable seat-belts on the Kawasaki Front-end Loader. (a)Northwest of Mechanic's Shop - On or about December 16, 2009 employees operating the Kawasaki 70 Z-III Front End Loader, Equipment #6541, were exposed to serious injury due to there only being one-half of an operable seat-belt present,
