The investigation revealed that trains were still active on an adjacent track; visibility was poor due to dust created by the ballast operation which limited visibility to approximately 10-15 feet; and the Ballast Regulator was traveling at approximately 20-25 mph. Inspection of the Ballast Regulator after the accident revealed significant amounts of dust on the windshield. According to management personnel, dust during the operation can get so thick that it interferes with traffic on Route 66. The investigation further revealed that the victim was wearing a reflective safety vest, but at the time of the accident may have had his back to the oncoming vehicle and been bending over, possibly reducing the warning effectiveness of the reflective vest.
