Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: On or about 7/5/2009, during the transfer of monorail Pink from the EPCOT loop to the Express loop, switch beams 8 and 9 were not locked into position and energized exposing the operators of the monorail Pink and monorail Purple to a struck by hazard resulting in the death of the operator of monorail Purple. Among other methods, acceptable and feasible means of abatement are: a)Comply with the manufacturer's operating instructions as described in the WED Transportation Systems, Inc. Mark VI Monorail Trains, chapter 13, En Route Information paragraph 13.2.11 Moving the Train in Reverse Direction "CAUTION: Moving a train in reverse is a potentially hazardous operation even under the best conditions. The use of an observer stationed at the opposite train end is strongly recommended. When backing a train, all Company regulations and restrictions must be complied with." b) Ensure the monorail's positive train control system is utilized without having to bypass the manufacturer's installed anti-collision system. c) Provide a written program of instruction, training and examination for the master control console operator located in the monorail maintenance shop. d)Ensure the central coordinator is positioned in the central control tower directing, controlling and monitoring monorail operations. e)Ensure clear and unobstructed visibility is maintained on all monorail train windshields while in operation.
