Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: (a)Employees performing unloading operations were exposed to struck-by hazards from failing hoist components, lift rigging, and/or anchorages, in that the hoist was used to laterally pull the unloader cars. Feasible means of abatement include, but are not limited to, repairing the malfunctioning equipment, designing an engineered replacement system, or using a winch. ASME B30.16 Overhead Hoists-Underhung 16-3.1.2 Applying the Load g) Hoists shall not be operated unless the hoist unit is centered over the load, except when authorized by a qualified person who has determined that the components of the hoist and its mounting will not be over-stressed. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
