29 CFR 005(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to : Location: 505 West 47th Street. On or about 07/16/09. a) Employees were exposed to falling,being struck and/or crushed by elevator. The employees were using a home made key to open the elevator doors. Among other methods, one feasable and acceptable method to correct this hazard is to comply with the American National Standards, Safety Code for Existing Elevators and Escalators stipulated by the American Society of Mechanical Engineers (ASME) ASME A 17.3 1996 2.7.3(a)(3) Safety Code for Existing Elevators and Escalators. 1) The operating means for unlocking the door shall be available to and used only by inspectors, elevator maintenance and repair personnel, and qualified emergency personnel. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19NCE
