Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the conditions listed below: On or about 10/16/2011, and times prior to, employees were working inside a freezer that did not have an emergency lighting system or emergency exit plan. In the event of a power disruption, employees would be trapped inside the freezer. NFPA 101 2006 7.9.2.3: The emergency lighting system must be arranged to provide illumination automatically in the event of any interruption of normal lighting. Feasible means of abatement: Installation of a emergency lighting system inside the freezer and.or implement an evacuation plan.
