Title 40.1-51.1(a) Code of Virginia: The employer, Sams Masonry, did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious bodily harm to employees. On July 9, 2009, at 9106 Dara Lane, Great Falls, Virginia, employees of Sams Masonry were using a six (6) foot step ladder for access and egress from a trench. They area were the ladder was being used was six (6) feet deep. The ladder was leaning against the end of the trench and was not fully open, with spreaders locked. One feasible and acceptable abatement method, among others, to correct this hazard is for the employer to use the ladder in accordance with American National Standards Institute (ANSI) A14.2-1990, Safety Requirements for Portable Metal Ladders, section 8.3.13.2 which provides as follows: "The user shall ensure that the stepladder if fully opened, with spreaders locked and all feet contacting firm level support surface."g
