North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards as a result of being in the danger zone: a)barge on Lake Norman, on June 16, 2009, an employee was standing in close proximity to a 30-foot, 3000-pound metal pole (spud) as it was being lifted by a Case CX210 excavator. When the spud inadvertently cleared the well, it fell forward, striking the employee. Among other methods, one feasible and acceptable abatement method to correct this hazard is to position the employee to the rear of the excavator until the spud was stabilized in the well.lized
