Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of electric shock due to the inadequate inspections of a Terex Scissors Lift, TS25RT: a/ At the job site, employees operating the Terex Scissors Lift, TS25RT, were exposed to the hazard of electric shock due to the complete absence of outer insulation belonging to flexible cord leading to the "joy stick". This unsafe condition occurred because of the inadequate inspections performed. One method of abatement to correct this apparent hazard is to begin the development and implementation of both frequent (monthly) and periodic (annual) inspections of all scissors lifts as required by ANSI A92.6-1999, paragraph 6.4.3.
