Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer did not ensure that forklifts were used in accordance with manufacturer's specifications, as follows: a.At 1000 E Fremont St, Las Vegas, NV, 10th Street Automotive employees used one Clark forklift (m/n C25BS; s/n C25BS-403-625-1164) with a wooden pallet to elevate personnel to a height of 10 feet 6 inches above the concrete ground. Employees elevated on the forklift contrary to manufacturer's warnings were subject to serious fall injuries. b.On Tuesday, April 21, 2009, employee #1 suffered crushed bone injuries to both feet and later amputation due to complications to the right leg just above the knee, after falling from a wooden pallet that had been lowered on the forks of a Clark forklift from the roof of the shop. The employee had been working on 3 swamp coolers on the roof prior to the accident. As employee #1 was being lowered to the ground, the forklift malfunctioned and the forks dropped with increasing speed and suddenly stopped, sending employee #1 flying against the shop wall and then to the ground. Reference: Clark Operator Manual - Elevate personnel only on an approved safety platform firmly secured to the lifting carriage and/or forks. Feasible Abatement - One feasible means of abatement would be to follow the operator's manual and use an approved platform secured to the lifting carriage and/or forks.
