Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by vehicular traffic: (a)Universal Fabrications, LLC., & 14th Street & Arapahoe Street, Denver, CO: On or before October 23, 2009, the exposing employer did not ensure that each employee performing sign installation activities within the workzone was wearing warning vest or other suitable garments marked with or made of reflectorized or high-visibility material. Although no speed limit signs were posted, the motor vehicles travelled at approximately 30 to 35 mph. This condition exposed employees to the hazard of being struck-by moving vehicles. (1)The hazard of being struck-by moving vehicles while working along the street lane Work Zone without wearing high-visibility reflective vests. Among others, one feasible and acceptable abatement method to correct this hazard is to ensure that each employee who works in traffic work zones wears suitable warning vests such as those that meet the specifications for reflective materials required in ANSI/ISEA 107-2004 STANDARD. Chapter 6D.- Pedestrian and Worker Safety as delineated in the Manual on Uniform Traffic Control Devices (MUTCD), 2003 Edition (Section 6D.03B Worker Safety Apparel) requires the use high visibility apparel such as those that meet ANSI/ISEA 107-2004 Standard for High Visibility Safety Apparel for risk exposure Class 2 or 3. Furthermore, a competent person designated by the employer is to be responsible for the worker safety plan within the activity area of the job site and should make the selection of the appropriate class garment.
