Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Title 40.1-51.1(a) Code of Virginia: The employer, James Zamudio's Tree & Landscape, did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious bodily harm to employees in that employees were exposed to fall hazards while conducting tree cutting operations at the residential worksite. On June 15, 2009, at 2214 N. Madison Street, Arlington, Virginia. an employee of James Zamudio's Tree & Landscape was working in a tree and using a pole saw when he fell 10 to 25 feet to the ground, striking his head on the asphalt driveway of the house. The employee was not tied off or otherwise secured while working in the tree. One feasible and acceptable abatement method, among others, to correct this hazard is for the employer to establish procedures and train employees in accordance with American National Standards Institute (ANSI) Z133.1-2006, Safety Requirements for Arboricultural Operations, section 8.1.19 which provides as follows: "The arborist shall be tied in or secured while ascending the tree. The arborist shall be tied in once the work begins and shall be tied in until the work is completed and he or she has returned to the ground. The arborist shall be secured when repositioning the climbing line."ng
