Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The Employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by approaching/passing vehicles while working on and adjacent to an active roadway: a)Kimberly, Idaho: On June 3, 2010, and times prior thereto, the employer did not enforce the use of high visibility vests for employees that were working on a residential city street installing water meter laterals and meters. Note 1: Abatement certification is required for this item. Note 2: Among other methods, one feasible and acceptable abatement method to correct this hazard would be to follow the final rule on Worker Visibility of the Federal Highway Administration (FHWA) Section 634.3 which requires use of high visibility, such as vests that meet ANSI/ISEA 107-2004 Standard for High Visibility Safety Apparel.
