Text For Citation: 01 Item/Group: 001 Hazard: GUARDING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were transported in an overloaded boat: a) for the four employees working at the worksite known as the Indian Fields Key, Pine Island, FL, on or 03/20/2009. The employees were transported in a 16 foot Crestliner outboard boat, Model #JWMV-1650-T, which was overloaded beyond the allowable U.S. Coast Guard Maximum Capacities for the boat. Between employees and equipment, the boat was overloaded by more than 200 pounds.
