Text For Citation: 01 Item/Group: 001 Hazard: FALLING
29 CFR 005.a(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to : a)Gas cylinder storage area, The employer did not ensure that gas cylinders such as argon were secure so that they would not tip over and strike each other. Argon cylinders were observed free standing on a private road where trucks frequent. Cylinder caps were also observed to be missing during the walkaround; on or about 04/28/09. The Compressed Gas Association Pamphlet-1 1965 states the following: Do not store cylinders near elevators or gangways, or in locations where heavy moving objects may strike or fall on them. Where caps are provided for valve protection, such caps should be kept on the cylinder for storage. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.0
