Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm. Employees were exposed to the hazards associated with dust explosion, deflagration or other fire hazards. Didion Milling Inc, filter collectors where located inside: a) 6th floor filters (NE, NC, NW, SW, SE) did not have explosion protective system b) packaging room expander filter did not have explosion protective system. c) pneumatic conveyor couplings were not bonded to the ducts. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS IS to comply with the National Fire Protection Association (NFPA) Chapter 61 "Prevention of Fires and Dust Explosion in Agriculture and Food Processing Facilities, 2008 edition. 6.1 Explosion prevention, relief and venting as used in this standard, shall encompass the design and installation of devices and system to vent the gases and over pressure resulting from a combustion explosion occurring in equipment, rooms, buildings, or other enclosures so that damaged in minimized. 6.3.1 Equipment requiring explosion prevention shall be protected by containment, suppression, inerting or explosion venting. 10.4.3 Dust collectors shall be located outside of buildings and shall be protected in accordance with section 6.3. 11.2.2 Bonding and grounding shall be electrically conductive. NFPA 69 "Standard on Explosion Prevention System" 2008 edition; NFPA 68 "Standard on Explosion Protection by Deflagration Venting" 2007 edition. ABATEMENT DOCUMENTATION REQUIRED PER 29 CFR 1903.19(d) Abatement Schedule: Step 1-A combination of administrative controls shall be implemented as an interim protective measure until feasible engineering and administrative controls can be permanently implemented. Step 2-A written detailed plan of abatement shall be submitted to the Area Director outlining a schedule for the implementation of engineering and/or administrative measures to control employee exposure to the hazardous condition as referenced in this citation. This plan shall include, at a minimum, target dates for the following actions which must be consistent with the abatement dates required by this citation: 1)Evaluation of engineering/administrative control options 2)Selection of optimum control methods and completion of design 3)Procurement, installation, and operation of selected control measures 4)Testing and acceptance or modification/redesign of controls; All proposed control measures shall be approved for each particular use by a competent certified safety professional, professional engineer, or other technically qualified person Step 3-Abatement shall have been completed by the implementation of feasible engineering and administrative controls upon verification of their effectiveness in achieving compliance.
