Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to: a)In the walk in cooler of Nelson Family Farms located at 5006 Oleander Avenue in Fort Pierce, Florida: An employee operating a powered industrial truck did not have the seat belt fastened, on or about August 25, 2009. Among other methods, a feasible and acceptable method to correct this hazard is to ensure each employee who operates powered industrial trucks wears a seatbelt and that all operators are properly trained to recognize the hazard.ze
