Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer di d not furnish to each of his employees employment and a place of employment whic h were free from recognized hazards that were causing or likely to cause death o r serious physical harm to employees in that employees were exposed to fall haza rds: On or about 05/05/2009, employees were exposed to falls of at least 9-feet 6-inches from the top of containers that were sitting on the surface of a marine terminal at 120 Macarthur Causeway, in Miami Beach, Florida.
