Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by vehicles when crossing an active lane of traffic without the use of an MOT vehicle escort. a) Site - Six Mile Cypress Slough Bridge - Interstate 75 South/ Colonial Boulevard - Fort Myers, Fl. Employees were not provided with an MOT vehicle escort when crossing an active lane of traffic, on or about, 04/03/09.
