Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) 94 Disbrow Hill Road, East Windsor NJ: Employees accessed the top of a CP-118 Rotochopper hopper by climbing its frame and sides exposing them to fall hazards of up to 91 inches to the ground surface below and/or approximately 73 inches into the bottom of the feed hopper. Condition existed on or about 07/23/09. Among others, one feasible and acceptable method to correct this hazard is to: Train employees to follow the manufacturer's warning signage posted on the sides of the feed hopper which says, "Warning: Fall Hazards Do Not Climb." NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
